Terms and Conditions

Welcome to Aurora Sound Studios. These terms and conditions govern your use of our services, including but not limited to recording sessions, mixing, mastering, and any other services offered by Aurora Sound Studios, located at 3400 Fremont Ave N, Seattle, WA 98103.

1. Acceptance of Terms

By using our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services. Aurora Sound Studios reserves the right to modify these terms at any time without prior notice. Your continued use of our services following any changes constitutes your acceptance of the new terms.

2. Booking and Payment

  1. Booking Confirmation: All bookings are subject to availability and confirmation by Aurora Sound Studios. A booking is considered confirmed only upon receipt of a deposit or full payment as specified in the booking agreement.
  2. Payment Terms: A deposit of 50% of the total session cost is required to secure your booking. The remaining balance must be paid in full upon completion of the recording session or service.
  3. Accepted Payment Methods: We accept payments via credit card (Visa, MasterCard, American Express), debit card, and bank transfer. Cash payments may be accepted with prior arrangement.
  4. Late Payment: Late payments may be subject to a late fee of 5% of the outstanding balance per week until the balance is paid in full.
  5. Cancellation Policy:
    • Cancellations made more than 72 hours prior to the scheduled session will receive a full refund of the deposit.
    • Cancellations made between 24 and 72 hours prior to the scheduled session will forfeit 50% of the deposit.
    • Cancellations made less than 24 hours prior to the scheduled session will forfeit the entire deposit.
  6. Rescheduling: Rescheduling requests must be made at least 48 hours prior to the scheduled session. Rescheduling is subject to availability and may incur a fee.

3. Studio Usage and Conduct

  1. Studio Hours: Studio hours are typically from 10:00 AM to 10:00 PM, but may vary based on specific bookings and staff availability.
  2. Responsible Use: Clients are responsible for using the studio equipment and facilities with care and respect. Any damage caused by negligence or misuse will be the financial responsibility of the client.
  3. Prohibited Activities: The following activities are strictly prohibited within the studio premises:
    • Smoking (except in designated outdoor areas).
    • Consumption of illegal substances.
    • Excessive alcohol consumption.
    • Any behavior that disrupts the recording process or endangers the safety of staff or other clients.
  4. Guest Policy: Clients are allowed to bring guests to the studio, but are responsible for their behavior and adherence to these terms and conditions. The number of guests may be limited at the discretion of Aurora Sound Studios staff.
  5. Cleanliness: Clients are expected to leave the studio in a reasonably clean and tidy condition after their session. Cleaning fees may be applied if excessive cleaning is required.

4. Intellectual Property Rights

  1. Ownership: Clients retain all intellectual property rights to their original recordings and compositions.
  2. Studio Recordings: Aurora Sound Studios retains ownership of all master recordings created during the recording session. Clients will receive copies of the master recordings upon full payment for services rendered.
  3. Usage Rights: Clients are granted a non-exclusive license to use the recordings for promotional, commercial, and artistic purposes. Aurora Sound Studios reserves the right to use excerpts of the recordings for promotional purposes, unless otherwise agreed upon in writing.
  4. Copyright: Clients are responsible for ensuring that they have all necessary copyright clearances for any third-party material used in their recordings.

5. Limitation of Liability

Aurora Sound Studios is not liable for any loss, damage, or injury to persons or property occurring on the studio premises, except in cases of gross negligence or willful misconduct on the part of Aurora Sound Studios or its employees. Our liability is limited to the amount paid for the services. We are not responsible for any consequential, indirect, or incidental damages.

6. Confidentiality

Aurora Sound Studios respects the confidentiality of its clients' projects and information. We will not disclose any confidential information to third parties without the client's explicit consent, unless required by law. Our engineers, including Elias Vance, are bound by confidentiality agreements to protect your creative work.

7. Indemnification

You agree to indemnify and hold harmless Aurora Sound Studios, its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including attorney's fees) arising out of your use of our services, your violation of these terms and conditions, or your violation of any rights of another.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in King County, Washington.

10. Amendments to Terms

We reserve the right to amend these terms and conditions at any time. All amendments will be posted on our website and will be effective immediately upon posting. It is your responsibility to review these terms periodically for any changes. Your continued use of our services after any changes have been made constitutes your acceptance of the new terms.

11. Severability

If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. This shall not affect the validity and enforceability of the remaining provisions.

12. Waiver

No waiver of any provision of these Terms and Conditions shall be effective unless it is in writing and signed by an authorized representative of Aurora Sound Studios. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
